How do I apply my Online Credit?

When you receive Lulus Online Credit, you will be sent an email notifying you. You will need that email to redeem your credit.
1. Find the email from sales@lulus.com. It will have a subject line of ONLINE CREDIT. You may need to check your spam folder to find this email.
2. Click on the Redeem button at the bottom of the email.
3. Once you have signed in, your Online Credit will automatically post to your account. You may use it at any time!

How do I make a return?

For US Customers, to return your item(s), follow the steps below:

If you checked out as a guest, click here to initiate your return and print the UPS Return label.

If you have an account with Lulus.com:
1. Sign In to your account.
2. Hover over My Account at the top of the page. Then select My Orders from the My Account dropdown.
3. Scroll down to locate the order which contains the item(s) you wish to return. Follow the prompts to initiate your return.
4. Print out the provided UPS or USPS label and tape it to the outside of your Lulus return.
5. Mail it off; we’ll do the rest!

**When returning items with our UPS or USPS label, a $7 shipping cost will be deducted from your refund credit. If your return is postmarked within 10 days from the day you receive your order, return shipping will be free.

Will I get charged for return shipping?

Never pay for return shipping! Postmark your item using our return label within 10 days after receiving your order. Lulus.com will cover the return shipping costs, and you will be refunded in full for the cost of your item.

Didn’t get it postmarked within 10 days? That’s ok! We accept returns postmarked within 30 days from when your order was shipped. Feel free to return your items using our return label or any other insured shipping carrier. If you choose to use our label, the label cost of $7 will be deducted from your merchandise refund. You may also ship back the return with an insured and traceable shipping carrier of your choice. We recommend obtaining a receipt for all shipments and keeping it for your records. Please note: When combining multiple orders as one return, the cost of the return label will be determined by the item with the oldest ship date.

How do I make an exchange?

1. Call us at 1-866-918-5858 (toll free for US & Canada).
2. Our customer service representatives will create a new order for the new item you would like to receive in exchange. You are charged at this time for the cost of the merchandise, and it will be shipped to you with free ground shipping within the contiguous United States.
3. Return the item(s) you would like to exchange by following the next four steps.
4. Sign In to your account, then select My Orders from the My Account dropdown.
5. Scroll down to locate the order which contains the item(s) you wish to return. Follow the prompts to initiate your return.
6. Print out the provided UPS label and tape it to the outside of your Lulus return.
7. Send back your return item(s).

No waiting! Your new items will be processed and shipped out promptly after contacting customer care. When your return is received and processed, we’ll email you a refund notification.

*When returning items with our UPS or USPS labels, a $7 shipping cost will be deducted from your refund credit. How long does it take to get refunded?

Including transit time most returns are processed in 10-14 business days. Once your return has been processed and your refund issued, you will receive a return confirmation email. We won’t leave you hanging!

Can I use more than one Promo Code on an order?

Unfortunately, our system is set up so that we can only apply one Promo Code per order. If you have any coupons with future expiration dates, make sure to save them for use on your next order!

How do I know if an item is going to be restocked?

If an item has an available restock date, it will be posted on the Product Page. Simply click on the size you are interested in and enter your email, and we’ll alert you when a full shipment has been received! Please note that these dates are estimated and dependent upon manufacturer availability. If an estimated arrival date is not yet available it means that we haven’t placed an order for the item just yet, so keep checking back in case a return is received in your size!

Free Shipping On US Orders Over $50

Orders over $50 qualify for Free Ground Shipping within US States. (Alaska + Hawaii Included)

When will my order ship?

Orders with Ground Shipping can take 2-3 business days to be processed and shipped. Expedited orders placed before 10:00 AM PT (1:00 PM ET) will be shipped the same day. Weekends and holidays are excluded from processing and shipping times, so please account for non-business days when choosing your shipping method. You will receive an email with tracking information when your order has been shipped.

What do you charge for Ground Shipping?

Ground Shipping is a flat rate of $5, and orders over $50 shipped within the Continental United States qualify for Free Ground Shipping. Orders shipped via Ground Shipping are typically shipped within 2-3 business days and arrive in 7 to 10 business days. Delivery days are Monday through Friday, and orders will not be delivered on Saturday, Sunday or Holidays.

Do you offer Expedited Shipping?

Yes! We offer Expedited Shipping options! Expedited Shipping is only valid for orders shipped within the Continental United States. Please contact customer service if you would like an expedited shipping quote for Alaska or Hawaii.

2ND DAY AIR
2nd Day Air is a flat rate of $18. All 2nd Day Air orders confirmed before 10:00 a.m. PT (1 PM ET) will be processed and shipped the same day, pending credit card verification. Orders placed after 10:00 AM PT (1 PM ET) will be processed and shipped the following business day. Orders placed on Friday after 10:00 AM PT (1 PM ET) will be shipped on the following Monday (excluding holidays).

3 DAY SHIPPING
3 Day Shipping is a flat rate of $9. All 3 Day Shipping orders confirmed before 10:00 AM PST (1 PM EST) will be processed and shipped the same day, pending credit card verification. Orders placed after 10:00 AM PT (2 PM ET) will be processed and shipped the following business day. Orders placed on Friday after 10:00 AM PT (1 PM ET) will be shipped on the following Monday (excluding holidays).

OVERNIGHT SHIPPING

Once I’ve placed my order, how long will it take to arrive?

Orders are typically shipped within 2-3 business days, and standard Ground Shipping orders arrive in 7 to 10 business days. You will be emailed a tracking number once your order has been shipped to track your package. For orders shipped outside of the continental United States please allow 8-21 business days for delivery.

Expedited orders will arrive within the number of business days designated by your shipping selection. To determine shipping days, begin with the first business day after your order is shipped. Orders placed before 10 AM PT (1 PM ET) will be shipped out the same day. Orders placed after 10 AM PT (1 PM ET) will be processed and shipped the following day.

For example, a 3 Day Shipping order placed on Monday after 10 AM PT (1 PM ET) will be processed and shipped out on Tuesday. Wednesday will be the first day of shipping, and it will arrive on the third day, Friday. Do you ship to P.O. Boxes or Military APO/FPO addresses?

We ship to APO/FPO and PO Boxes with standard shipping for $5. Delivery time to APO/FPO and PO Boxes varies and is generally longer than our standard 4-10 business day Ground Shipping. Please contact our customer service department at 1-866-918-5858 or love@lulus.com with your request, and they will be able to assist you in placing your order.

Do you ship to Alaska, Hawaii or Puerto Rico? What does it cost?

Orders are shipped to Alaska and Hawaii via the United States Postal Service (USPS) for a flat rate of $7, and orders over $50 qualify for Free Shipping. Orders shipped to Puerto Rico are a flat rate of $13. Delivery to Alaska, Hawaii and Puerto Rico generally takes 8-21 business days. Orders are shipped via the United States Postal Service (USPS). We email a tracking number when your package ships, and you can track your package at https://www.usps.com/.

How can I track my order?

Once your order has shipped, you will be emailed a tracking number. Tracking will be available the day after your order is shipped out. If your order is shipped via UPS, you will be provided an estimated delivery date when you track the package at https://www.ups.com/. If your order is shipped via USPS, you can view the progress by tracking your package at https://www.usps.com/.

What are the shipping charges for using the UPS Return Label?

We offer Free Return Shipping if you use our UPS Return Label within 10 days of package arrival date. If your order is postmarked for return within 10 days of receipt, return shipping with the UPS Return Label will be free. If any items are returned after 10 days of receipt, the return shipping charge of $7 will be assessed. You may also ship back the return with an insured and traceable shipping carrier of your choice. We recommend obtaining a receipt for all shipments and keeping it for your records. We can not provide a return label for Hawaii and Alaska.

How do I change my shipping address once my order is placed?

If you have entered an incorrect shipping address, please call us as soon as possible toll free at 1-866-918-5858 so that we can correct your address. Once your package has shipped, UPS charges an $12 intercept fee plus transportation fees to change an address. This charge can be billed to your original method of payment, or a new method of payment can be provided to cover these costs.

What happens if I refuse a package or it is undeliverable?

Refused or undeliverable packages are subject to a $7 return fee and 15% restocking fee.

Want to reship a refused or undeliverable package? The new shipping costs depend on which new shipping method you choose. If you would like to cancel an order that has been returned to us, you will be responsible for a $7 return shipping fee and a 15% restocking fee will be deducted from your refund to cover the cost of processing your order. Am I charged extra for shipping backordered items?

You will be charged shipping and handling only once. There are no additional shipping charges for backordered items that ship separately from the original order. Backordered items are sent via Ground Shipping.

What is your Return and Exchange Policy?

 

  • We accept returns postmarked within 30 days from the date your order was shipped.
  • Refunds are issued to your original payment method or in the form of online credit. Refunds cannot be returned to alternate cards or different forms of payment.
  • If you choose to be refunded in Lulus Online Credit, you will receive an additional $5 in merchandise credit once your refund has been processed! This does not apply to late returns, or those otherwise outside of policy. Limited to one bonus credit per order.
  • Returns must be received in new condition; unused, unworn, unwashed with the hygienic liner intact (where applicable). Items returned with obvious use, makeup, deodorant, perfume, or similar product stains will be subject to refusal.
  • Shoes must be returned in their original box and placed inside an additional protective shipping box. Damage to the shoe box makes the shoes ineligible for return. The shoes will be shipped back to you and are subject to additional shipping costs.
  • Final Sale items cannot be returned, refunded or exchanged.
  • Gift cards cannot be returned or refunded.
  • Jewelry and Sunglasses under $25 are returnable but not exchangeable.
  • Original shipping is non-refundable.

Do I have to pay for my new exchange now?

To make exchanges fast and easy, we create a new order for the exchange item you’d like to receive. When the order is created, you are asked to provide a method of payment that will be charged at that time. After the order is paid for, it will be processed and shipped out promptly. When we receive your return, you will be refunded for your original item(s).

How long do I have to make a return or exchange?

Can I send back items from different orders?

How do I get a Return Label?

Once you initiate your online return, you will be prompted to print a UPS or USPS Return Label. You can also print a Return Label by signing into your Lulus account. In your Order History, click on your return order. Once on your order page, scroll down and click the Show Return History button to find a Print Return Label button.

Our preprinted return labels are only for use in the United States. International returns are responsible for return shipping. We recommend shipping with insurance and keeping your shipping receipts until your return is processed. If Lulus return labels are used outside of the United States they will incur additional charges that will be the responsibility of the sender.

How do I print a Return Form?

Once you initiate your online return, you will be prompted to print a Return Form. You can also print a Return Form by signing into your Lulus account. In your Order History, click on your return order. Once on your order page, scroll down and click the Show Return History button to find a Print Return Form button. We recommend you print this form and include it with your return. If you cannot print a Return Form, we recommend writing your order number on a slip of paper and including it with your return.

What if my package was refused or was undeliverable?

You are welcome to call our customer service team to set up an exchange any time. We offer free shipping on the first exchange from each order. You may request a second exchange on any order; however, shipping will be assessed on completion of your new exchange order.

How do I place an order?

What forms of payment do you accept?

We accept Visa, MasterCard, Discover, JCB, Diners Club International, PayPal, Lulus Gift Cards, and Lulus Online Credit. For international orders, you must have a verified PayPal account to complete your purchase. If you are using a prepaid gift card, you will need to register a billing address with the credit card company before placing an order.

Is it safe to use my credit card on your site?

Yes! Orders placed on our site are encrypted using SSL technology, the industry-standard authentication and encryption technology, to ensure your transactions are protected. With SSL implemented on both the client and server, information transmitted over the internet will remain unaltered and secure. If you have any concerns about placing your order online, please order by phone at 1-866-918-5858.

Do you allow cashier's checks or money orders?

Unfortunately, we do not accept these forms of payment, but we do accept Visa, MasterCard, Discover, JCB, Diners Club International, PayPal, Lulus Gift Cards, and Lulus Online Credit.

Do you charge sales tax?

We are required to collect a California sales tax of 7.25%. All orders shipped to California addresses will be charged this tax.

How do I check my Order Status?

Once you have submitted your order, a confirmation email will be sent to the email address associated with your account. Orders generally take 1-2 business days for processing and may be subject to payment verification.

To check the current status of your order or to view your order history:

  1. 1. Sign In to your Lulus account.
  2. 2. Hover over My Account at the top of the page. Then select My Orders from the My Account dropdown.
  3. 3. Scroll down to locate the order you’re interested in and click on the order number to display the order details.

What happens if my order is undeliverable?

When a package is refused or undeliverable, the shipping company will charge Lulus for the return delivery cost. If you choose to refuse or do not coordinate pickup of the items you ordered, you will be responsible for return shipping costs.

If you would like to have your package re-shipped, please contact customer care at 1-866-918-5858 M-F 5am-9pm to coordinate shipping. If you would like to cancel your refused/undeliverable order, you will be responsible for return shipping costs and a 15% restocking fee will be deducted from your refund to cover the cost of processing your order.

What if the item I want is Out of Stock?

See something you like that’s sold out? Sign up using the fields on the product page to be notified if an Out of Stock item comes back in; but until then, check out our site for daily updates and new products.

How do I get a promo code?

We offer many promotional codes on our Facebook, Instagram and Twitter pages. We also offer a 10% promo code for customers who sign up for our email. Like, follow, and sign up now to be the first to know about our sales and promotions!

Do you accept international credit cards?

At this time we accept Mastercard, Visa, Discover, JCB, and Diners Club International.

Can I modify or cancel my order after it has been placed?

Here at Lulus, we work hard to process your order as quickly as possible. We recommend thoroughly reviewing all information prior to submitting your order.

If your order is in a pending status, we may be able to make modifications, shipping changes. or cancel your order. Please call us immediately at 1-866-918-5858 if you require a change.

Once an order has been processed, we are unable to change the contents of your order. However, shipping changes may still be made via phone at 1-866-918-5858.

Once an order has been shipped, we are unable to change the contents of your package or the method of shipping. Address corrections may still be possible depending on the destination of the package. Additional fees may apply.

How do I track my order?

You will be sent an order confirmation email once your order has been received. A second shipping confirmation email will be sent once your order has been mailed, and it will include the tracking number for your package.

How do I create an account?

  1. Hover over Account at the top right of the page and click on Sign In.
  2. A pop-up box will prompt you to create an account.
  3. Fill out the form completely.
  4. Press the Create Account button when completed.
  5. Check your email for a confirmation of your account creation.

What if I forgot my password?

No problem! Click here to be be sent an email to reset your password. It will be sent to the email associated with your Lulus account.

How can I unsubscribe to your emails?

Click here to unsubscribe to our emails. You will be directed to a page where you can enter the email address that you would like to have unsubscribed.

I can't sign in to my account! What do I do?

Sign in error is often due to a typo in either your email address or password when you originally created your account. Please contact us via email at love@lulus.com or by phone at 1-866-918-5858, and we will search for your account using other information to correct this problem. Passwords are case sensitive, so make sure you have correctly typed in your password. If you have forgotten your password, please click the Forgot Password link in the Sign In box and we will send you an email to reset your password. You can change this password later under the Edit section of your Account Info under the My Lulus feature of your account.

How do I make changes to my account information or email address?

If you would like to change any of your Lulus account information, including name, email address, and/or telephone number, follow these steps:

  1. Sign In to your account.
  2. Click on My Account at the top of the page.
  3. On the left side of the page, there is a section that says Account Info.
  4. Click Edit Information.
  5. Change any of the desired fields and click Update.

How do I change my account password?

If you would like to change your account password, follow these steps:

  1. Sign In to your account.
  2. Click on My Account at the top of the page.
  3. On the left side of the page, there is a section that says Account Info.
  4. Click Edit Information to change any of your account information. Click the black Change Password button at the bottom left of the pop-up.
  5. Fill in the fields and click Update.

Sizing and Fit

Do you have any measuring tips?

Yes! Use the tips below to help find the best size for you! Remember: when comparing your measurements to those listed on the site, make sure to check if the fabric is stretchy or not. If it is, it can stretch an inch or more.
Bust: Wrap the measuring tape loosely around the fullest part of your bust to ensure a comfortable fit.
Waist: Measure the narrowest part of your natural waist, holding the measuring tape loose enough to fit comfortably.
Hips: Drape the measuring tape around the widest part of your hips, resting the tape comfortably against your body.
Length: For tops and dresses, measure from the top of your shoulder to the hem. For strapless dresses, measure from the highest part of the neckline to the hem. For pants and skirts, measure from the top of the waist to the hem.
Sleeve: With your arm outstretched, measure from the base of your neck to the end of the sleeve hem to determine where the sleeve length will fall on you.

Lulus.com, along with its representatives, officers, shareholders, subsidiaries, affiliates, parents, employees, and agents (collectively “Lulus” or “we” or “us” or “our”), provide the Website to you subject to the provisions, which you acknowledge, agree to, and consent to by clicking “I Agree” or by using the Website. As discussed further below, both you and Lulus agree, with the limited exceptions noted below, to resolve all disputes between you and Lulus through BINDING ARBITRATION as further provided below. ARBITRATION MEANS THAT YOU AND THE COMPANY ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

These Terms may be amended by us from time to time. Please periodically review the controlling, online version of these Terms. By clicking “I Agree” or continuing to use the Website subsequent to us making available an amended version of these Terms, you thereby acknowledge, agree to, and consent to such amendment.

We do not represent the Website is governed by or operated in accordance with the laws of other nations, or that the Website or any portion of it is appropriate or available for use in any particular location. If you choose to access the Website, you do so at your own risk, and you are responsible for complying with all local laws, rules and regulations.

We provide users with access to communications tools, which may be accessed through any medium or device now known or hereafter devised, including websites, software, and applications that deliver and receive information through a network of properties. Unless explicitly stated otherwise, any new tools that alter or improve the current Website shall be included in the definition of “Website.”

Our Website provides information regarding a variety of clothing products and accessories.

Accessing the Website

You may access portions of the Website without registering. However, in order to access some portions and features of the Website, and to make purchases, you will be required to register an account with and sign into the Website. You are responsible for maintaining the confidentiality of your username, password and other information used to register and sign in to the Website, and you are fully responsible for all activities that occur under this password and username. In the event you use our Website over mobile devices, you hereby acknowledge that your carrier’s normal rates and fees, such as excess broadband fees, will still apply.

Pricing and Product Descriptions

Although we make reasonable efforts to provide accurate pricing information and product descriptions, pricing mistakes, typographical errors or mistakes regarding product availability may occur. We reserve the right to correct such mistakes and errors. We cannot guarantee that information displayed on the site is 100% accurate. In the event that a product is listed at an incorrect price or a product description is inaccurate, we shall have the right, in our sole discretion, to reject any order or to cancel any orders placed for that product. In those circumstances, if your credit card has already been charged, we will issue a credit to your credit card within a commercially reasonable amount of time.

We make reasonable efforts to display, as accurately as possible, the colors of our products. However, the actual colors you see depend on your monitor or device, and thus we cannot guarantee that the colors of products you see when viewing the Website will be accurate.

Order Limitations

We reserve the right to limit, in our sole discretion, the quantities of any product that may be purchased on a per person or per order basis.

Shipping, Guarantee and Return Policies

Please refer to our Shipping Policies, Guarantees and Return Policies at http://www.lulus.com/customerservice/returnspolicy for more information on our shipping rates and other policies and procedures, all of which are incorporated herein by reference. We accept returns postmarked within 30 days from the date your order was shipped. Refunds are issued to your original payment method or in the form of online credit. Refunds cannot be returned to alternate cards or different forms of payment. If you choose to be refunded in Lulus Online Credit, you will receive an additional $5 in merchandise credit once your refund has been processed! This does not apply to late returns, or those otherwise outside of policy. This officer is limited to one bonus credit per order. Returns must be received in new condition; unused, unworn, unwashed with the hygienic liner intact (where applicable). Items returned with obvious use, makeup, deodorant, perfume, or similar product stains will be subject to refusal. Shoes must be returned in their original box and placed inside an additional protective shipping box. Damage to the shoe box makes the shoes ineligible for return. The shoes will be shipped back to you and are subject to additional shipping costs. Final Sale items cannot be returned, refunded or exchanged. Gift cards cannot be returned or refunded. Jewelry and Sunglasses under $25 are returnable but not exchangeable. Original shipping is non-refundable.

Our Intellectual Property

Lulus and our associated logos and names Lulu’s, LuLu*s, Lulus.com, and Lulu’s Fashion Lounge, Inc. are our trademarks and/or service marks. Other trademarks, service marks, names, and logos used on or through the Website, such as trademarks, service marks, names, or logos associated with third party organizations, are the trademarks, service marks, or logos of their respective owners. You are granted no right or license with respect to any of the foregoing trademarks, service marks, or logos.

Certain materials available on or through the Website are our Works (i.e., Content we own, authored, created, purchased, or licensed). Our Works may be protected by copyright, trademark, patent, trade secret, and/or other laws, and we reserve and retain all rights in our Works and the Website. We hereby grant you a royalty-free, limited, revocable, non-sublicensable, and non-exclusive license to access our Works solely for your personal use in connection with using the Website. You may not otherwise reproduce, distribute, communicate to the public, make available, adapt, publicly perform, link to, or publicly display the Works or any adaptations thereof unless expressly set forth herein.

Prohibited Conduct/Representations and Warranties

Jurisdictional Restrictions

SOME JURISDICTIONS MAY NOT PERMIT CERTAIN LIABILITY LIMITATIONS OR WAIVERS. IF ANY COURT DETERMINES THE LAW OF SUCH A JURISDICTION APPLIES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Release

If you have a dispute with one or more users of the Website, or with any party who provides advertising or third-party services on or through the Website, or with any party who provides a website linked to on the Website, you release us from any and all claims, demands, and damages (incidental, indirect, punitive, statutory, exemplary, expectation, special, or consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute. You also waive California Civil Code § 1542 which says:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

You also waive any and all benefits and rights that would otherwise accrue to you by reason of the provisions of any federal or state statute or principle of common law of any state of the United States, or any political entity or nation, province or local law or regulation that may govern this release, which statute, regulation, law or principle provides in substance something similar to California Civil Code § 1542. You agree not to file any action or lawsuit inconsistent with the foregoing release.

Dispute Resolution; Limit on Time to Bring Claim; Arbitration of Claims; Class Action Waiver

ANY CLAIM OR CAUSE OF ACTION RELATING TO, ARISING UNDER OR OUT OF YOUR USE OF THE WEBSITE, INCLUDING ANY SALES MADE THROUGH THIS WEBSITE, MUST BE FILED WITHIN ONE YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

Both you and Lulus agree, with the limited exceptions noted below, to resolve all disputes between you and Lulus through BINDING ARBITRATION as further provided below. ARBITRATION MEANS THAT YOU AND THE COMPANY ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Any dispute submitted to arbitration under these Terms shall be governed by the laws of your home state of residence without respect to its choice (or conflict) of laws rules.

Jurisdiction and venue for any dispute shall be in Los Angeles, California. Each party submits to personal jurisdiction and venue in that forum for any and all purposes. If this paragraph would render any other paragraph or provision of these Terms unenforceable, then jurisdiction and venue shall instead be in your home county of residence.

The arbitration shall take place in Los Angeles, California, in accordance with the Consumer Arbitration Rules of the American Arbitration Association. Those rules are available at: http://www.adr.org.

This arbitration agreement is subject to the Federal Arbitration Act and is enforceable pursuant to its terms on a self-executing basis. Either party may seek enforcement of this provision in any court of competent jurisdiction.

The arbitrator shall determine any and all challenges to the arbitrability of a claim. The arbitral award shall be judicially enforceable. Any court of competent jurisdiction may, and upon request shall, enter judgment on the arbitral award. Either party may seek confirmation (judgment on the award) and/or enforcement in any court of competent jurisdiction.

Both you and Lulus waive the right to bring any claim covered by this dispute resolution provision as a class, consolidated, representative, collective, or private attorney general action, or to participate in a class, consolidated, representative, collective, or private attorney general action regarding any claim covered by this dispute resolution provision brought by anyone else.

Notwithstanding any provision in the Consumer Arbitration Rules to the contrary, the arbitrator shall not have the authority or any jurisdiction to hear the arbitration as a class, consolidated, representative, or private attorney general action or to consolidate, join, or otherwise combine the claims of different persons into one proceeding. If a proposed class, consolidated, representative, collective, or private attorney general action arbitration is initiated notwithstanding the above prohibition and it is finally determined by the arbitrator (or a court of competent jurisdiction) that the waiver specified herein is not enforceable, then the entirety of this Dispute Resolution procedure shall be null and void.

Notwithstanding the foregoing binding arbitration procedure, either party may bring an individual action in small claims court (provided the claim otherwise qualifies for such program) as an alternative to proceeding with arbitration.

You may elect to opt out (exclude yourself) from the final, binding arbitration procedure and the class action waiver specified in these Terms by doing the following. Within 15 days of making your first purchase from Lulus under these Terms, you must send a letter to Lulus, Attn: Legal Department, 195 Humboldt Avenue Chico, CA 95928 that specifies (1) your name, (2) your account member name, (3) your mailing address, and (4) your request to be excluded from the final, binding arbitration procedure and class action waiver specified in these Terms. All other Terms shall continue to apply to you and your account, including the requirement to participate in pre-dispute mediation. You are not required to send the letter by confirmed mail or return receipt requested, but it is recommended that you do so. Your request to be excluded will only be effective and enforceable if you can prove that the request was postmarked within the applicable 15-day deadline.

Termination

You agree that Lulus may, without prior notice, immediately terminate, limit your access to, or suspend your account based on any of the following: (a) breach or violation of these Terms; (b) upon request by law enforcement; (c) unforeseeable technical or security issues or problems; (d) extended periods of inactivity; or (e) fraudulent, deceptive, or illegal activity, or other activity which Lulus believes is harmful to this Website or its business interests. You agree that termination, limitation of access and/or suspension shall be made in Lulus’ sole discretion and that Lulus shall not be liable to you or any third party for the termination, limitation of access, and/or suspension of your account.

You may terminate your account with Lulus and these Terms at any time by emailing us at love@lulus.com.

We may terminate these Terms for any or no reason at any time by notifying you through a notice on the Website, by email, or by any other method of communication. Any such termination will be without prejudice to our rights, remedies, claims, or defenses hereunder.

Upon termination you will no longer have a right to access your account or your User Content.
